KUALA LUMPUR: A policeman will be charged at the Petaling JayaSessions Court today for causing injuries to suspected car thief A.Kugan while he was detained at the Taipan police station.


The policeman, identified as constable Navindran Vivekanandan, inhis 20s, was seen beating Kugan on two occasions on Jan 16 with arubber hose, according to an official statement.

Navindran would be charged under Section 331 of the Penal Code forvoluntarily causing grievous hurt to extort confession or,alternatively, under Section330 for voluntarily causing hurt to extort a confession.
Navindran faces a possible a jail sentence of between seven and 10years for the charge under Section 331 or a maximum seven-year jailterm ifcharged under Section 330.

Attorney-General Tan Sri Abdul Gani Patail, in a statement releasedyesterday, said four eyewitnesses had identified Navindran as theperson who had caused injuries to Ku g a n .


However, Gani said he was led to believe that Kugan had assistedand led police to four different locations during investigationsbetween Jan 16 and 20.


Kugan was arrested in connection with investigations into a cartheft syndicate on Jan 15 and had died at the Taipan police station onJan 20.Gani said this showed that Kugan did not suffer an instant death and only died four days after the beatings.
“There is a wide gap in between, and a charge of murder could not be preferred
against the policeman.” He added that the findings of the medical report did not show thatKugan died due to his injuries but it was the result of acutemyocarditis, a viralinfection of the heart.

Gani said in the course of investigations, police had recorded 92 statements from lay persons, experts and policemen.
Navindran was part of the investigation team and was also involvedin interrogating the suspect and watching over Kugan during hisdetention.


It was learnt thatNavindran had been in the force for five years, of which three as with the Taipan police station.
He had been assigned to desk duties at the Selangor police headquarters after investigations into Kugan’s death began.
Ku g a n ’s death sparked a huge outcry from his family who blamedpolice. Despite a post-mortem carried out at the Serdang Hospital, hisfamily took his remains to University Malaya Medical Centre where theyasked for a second
autopsy.


“On obtaining the report of the second autopsy, the family allegedthat there were attempts by the authorities to cover up the cause ofKugan’s death in custody and lodged a complaint with me,” Gani said.The A-G said the family also lodged a report with the Malaysian Medical Councilagainst Dr Abdul Karim Tajuddin, who conducted the first post-mortem.


As a result of the allegation, Health director-general Tan Sri DrIsmail Merican had set up an Independent Investigation Committeecomprising local and foreign doctors to conduct an in-depth study of both post-mortem reports.
The family, however, insisted that the MMC conduct a separate inquiry and thecouncil sanctioned a Preliminary Investigation Committee II to look into the complaint. The first committee came out with its conclusion on March 26, while the second

committee had postponed its hearing to Oct 9.

Bagus la didakwa agar dpt buka sikit mata orang yang pasukan polis tidak berkompromi walaupun melibatkan anggota mereka sendiri. Walaupun si mati tu OKT dia tidak sepatutnya di dera ( kalau betul sebagaimana didakwa).

Mungkin anggota terlibat terlalu emosi semasa menjalankan soal siasat, ada bukti dakwa aje, lagipun keluarga si mati berhak tahu punca kematian anaknya.
